I am senior associate in our international HR team in Denmark, specialising and advising in labour and employment law.

At Bird & Bird, we have previously described the EU's Pay Transparency Directive, including that the directive must be implemented in Danish law by 7 June 2026 at the latest.

There are now less than five months to go before the directive must be implemented, and we have yet to see the publication of a bill aimed at implementing the directive.

There have previously been reports, both in Denmark and in other EU Member States, that efforts would be made to postpone the implementation deadline. However, these efforts appear to have been in vain, as the European Commission has confirmed that the implementation deadline of 7 June 2026 will be maintained.

It is therefore expected that employers will have very little time to adapt and prepare for the national implementation of the Pay Transparency Directive.

However, it would be advantageous to start preparing for the directive now, including carrying out the necessary categorisation of employees – i.e. dividing employees who perform the same work or work of the same value.

For further information on the Pay Transparency Directive, please visit Bird & Bird's dedicated page on the directive and the status of its implementation in Denmark and other Member States.

When the Danish bill is published, Bird & Bird will issue a new newsletter and hold a webinar in English.
