In particular, I have extensive experience acting on Administration appointments and negotiating business and asset sales, having acted both Administrator and the buyer side. I also regularly advise directors of financially distressed companies on their statutory duties. Additionally, I provide guidance to secured lenders on the validity and priority of their security and their enforcement options in the context of borrower default. I also advise insolvency practitioners in respect of their statutory duties, including regarding creditor approval and reporting obligations.
My contentious experience includes both presenting and opposing winding-up petitions, as well as bringing technical applications under the Insolvency Act on behalf of Administrators, including those under paragraphs 71 and 107 of Schedule B1. I have acted for office holders in pursuing claims regarding antecedent transactions, in particular regarding preferences and transactions at an undervalue. I have also acted beneficiary side in defending preference claims.
I also have experience in energy sector distress, having been seconded to Ofgem's consumer energy team, advising with a focus on the supplier of last resort process.
