Understanding the EU e-Evidence Package - Compliance and Challenges

The EU e-Evidence Package establishes a harmonised framework allowing law enforcement and judicial authorities in one EU Member State to directly request the production or preservation of electronic evidence (subscriber, traffic and content data) from a service provider’s contact point in another EU Member State. The e-Evidence mechanism introduces tight response deadlines and facilitates the exchange of communications and data through a dedicated IT system, effectively bypassing traditional mutual legal assistance procedures. The underlying e-Evidence Regulation is directly applicable in all EU Member States from 18 August 2026.

Who is affected by the EU e-Evidence Package?

The Regulation applies to service providers offering electronic communication services, internet domain name and IP numbering services, or information society services that enable user communication or data storage/processing. Non-EU providers are also covered if they offer services to users within the EU.
