Reports of Trade Mark Cases for CIPA July 2021

This month, we report on the Court of Appeal’s judgment in UK Gymnastics Ltd v British Amateur Gymnastics Association (Lewison, Bean & Arnold LJJ; [2021] EWCA Civ 425; 24 March 2021) regarding an appeal against the judge’s finding on passing off. We also report the GC’s decision on likelihood of confusion in Sun Stars & Sons Pte Ltd v EUIPO (T-637/19 and T-638/19), and comment on the decision in Tornado Boats International ApS v EUIPO; David Haygreen (T-167/20) regarding an invalidity action.
