This month, we report on the CJEU’s judgment in Husqvarna AB v Lidl Digital International GmbH & Co. KG (CJ; C-607/19; 17 December 2020) on the relevant date in a counterclaim for revocation on the basis of non-use. We also report the High Court’s decision in easyGroup Ltd v Easylife Ltd & Anr* (Judge Briggs (sitting as a High Court Judge); [2021] EWHC 2150 (Ch); 29 July 2021) regarding trade mark infringement and passing off.
