What's next for the EU Data Act

As a Regulatory and Public Affairs Advisor, I assist clients in understanding the EU decision-making processes and the impact of EU laws on their sectors.

The EU Data Act is the new EU law that aims to create a single market for data. As the law entered into force on 11 January 2024, the focus of the EU legislators and stakeholders will now shift to its application, its implementation, and its sectoral dimensions. The end goal is to ensure that data can be easily and safely shared across organisations and sectors within the EU to drive innovation while ensuring the privacy and protection of personal data.

Forthcoming deadlines

Most of the rights and obligations in the Data Act will apply from 12 September 2025. However:

  • The obligation resulting from Article 3 (1) on B2b data access by design shall apply to connected products and the services related to them placed on the market after 12 September 2026.
  • Chapter IV will apply from 12 September 2027 to contracts concluded on or before 12 September 2025 provided that they are:
    • of indefinite duration; or
    • due to expire at least 10 years from 11 January 2024.
