As a lawyer in our Public Projects and Procurement Practice Group, I support and represent clients in the public sector in public procurement procedures. I primarily advise on issues relating to public procurement, IT contract law, regulatory law, EU state aid law and subsidy law in connection with the digital transformation (e-government, cloud computing, IT consolidation, e-health & smart city data platforms).
My consulting focus is on IT procurement in the intersection between antitrust procurement law and IT law (EVB-IT contract law, data protection law and IT security).
In this context, I provide support both in the preparatory phase (applications for funding, procurement concept, procedural design and preparation of tender documents) and in the subsequent implementation of the procedure.
During the project, I advise on risks of recovery arising from EU state aid law (Art. 106 - 108 TFEU, SGEI exemption decision, SGEI framework, GBER) and/or from subsidy/grant law (e.g. §§ 48, 49, 49a VwVfG, §§ 23, 44 BHO, VV-BHO, ancillary provisions: ANBest-I, ANBest-P, ANBest-Gk, ANBest-P costs).
I represent clients before the public procurement review bodies/courts with great commitment and assertiveness.
After the conclusion of the contract, I advise on contract controlling in the event of performance disruptions, on change request management and contract modifications.
I supervise in-house contract awards in the municipal service network, inter-municipal cooperations as well as instate transactions.
My main concern is to balance the interests of the state and the private sector in the best possible way and to make a contribution to the fulfilment of the state's tasks/provision of services of general interest.
My maxim is to develop practical, economically efficient and innovative solutions for clients.
