The legislation that supports the implementation and enforcement of the Data Act in Denmark was adopted on the 11th of December 2025.
From the adopted legislation (the “Legislation”), the competent authority responsible for enforcing the Data Act in Denmark the Agency for Digital Government (“Digitaliseringsstyrelsen”).
No maximum penalty has been prescribed in the Legislation; the penalties in the Legislation, which is fines, will be effective, proportionate and dissuasive with reference to the Data Act’s article 40(1) and 40(3)(a-f).
