On the 30/04/2025, the Agency for Digital Government sent the proposed implementation legislation into consultation in a consultation letter to relevant stakeholders.
The consultation phase, meaning the period for the relevant stakeholders to express their thoughts on the implementing legislation, ended on the 30/05/2025, but the proposed legislation has not yet been drafted in the Danish Parliament (“Folketinget”).
From the proposed legislation from the implementing legislation’s consultation phase, the proposed competent authority responsible for enforcing the Data Act in Denmark is set to be the Agency for Digital Government (“Digitaliseringsstyrelsen”).
No maximum penalty has been prescribed in the proposed legislation from the consultation phase; the penalties in the proposed legislation, which is set to be fines, will be effective, proportionate and dissuasive with reference to the Data Act’s article 40(1) and 40(3)(a-f).
