Data Act Tracker

The Data Act was adopted by the European Parliament and Council in November 2023 and came into force on 11 January 2024.

Most of the rights and obligations under the Data Act will take effect from 12 September 2025, which is 20 months after the Regulation’s entry into force. There are longer lead-in periods for specific provisions: changes to product design and manufacture will apply from 12 September 2026, and certain provisions related to unfair contractual terms will apply from 12 September 2027.

Member States are currently in the process of transposing this significant legislation into their national laws.

The Bird & Bird EU Data Act Implementation Tracker offers essential information to help businesses monitor the status of national implementation. Member States may extend the scope of the Data Act and propose additional national obligations for market compliance. We are available to provide further guidance as needed. If you have any questions or would like to learn more about how we can assist you in preparing for the new legislation, please get in touch.
