A draft bill implementing legislation has been sent on November 7, 2025 by the Federal Government to the German Federal Council (Bundesrat).

The proposed maximum penalty (Bußgeld) is EUR 5 MEUR or in the case of a company with annual turnover above 26 MEUR, up to 2% of its annual turnover in the European Union in the previous financial year. In addition, coercive fines (Zwangsgelder) of up to Euro 500,000 (these may be imposed repeatedly until compliance has been achieved).
