Name of Competent Authority/Data Coordinator

The MDIA, together with the Malta Communications Authority (MCA), are the prospective Competent Authorities responsible for the application and enforcement of the provisions of the Data Act. The MDIA is the prospective Competent Authority for all the provisions of the Data Act, except for Articles 23–31 and Articles 34–35, for which the MCA is the prospective Competent Authority. 

The MDIA is the prospective Data Coordinator to facilitate cooperation between the competent authorities both at national and EU levels and to assist entities within the scope of the Data Act on all matters related to its application and enforcement. 

What is the maximum penalty?

€350,000 for each infringement or failure to comply and, or twelve thousand euro (€12,000) for each day of infringement or non-compliance as the case may be.
