Spain is currently not participating in the UP or the UPC and challenged the legality of the use of the enhanced cooperation agreement and the proposed trilingual language (English, French and German) regime for the unitary patent with the ECJ, both of which were dismissed in April 2013. Spain filed two new appeals against the Unitary Patent Regulations, however Advocate-General Bot advised to dismiss these appeals in his opinion of 18 November 2014. On 5 May 2015 the Court of Justice of the European Union rejected the appeals filed by Spain against the Unitary Patent Package. This was a highly significant decision as it meant that the implementation of the Unitary Patent Package could then continue without further delay.
