Reports of Trade Mark Cases for CIPA October 2021

This month, we report on the Court of Appeal’s judgment in Mr Ian Thomas v Luv One Luv All Promotions Ltd, Mr Winston Thomas* (Lewison, Newey & Lewis LLJ; [2021] EWCA Civ 732; 20 May 2021)) regarding an IPEC decision to partially strike out a defence to a passing off claim due to issue estoppel. We also report the GC’s decision on likelihood of confusion in Zoom KK v EUIPO; Facetec, Inc. (T-204/20), and comment on the decision in Asolo LTD v EUIPO; Red Bull GmbH (T-509/19) regarding an invalidity action.
