Reports of Trade Mark Cases for CIPA February 2022

This month, we report on the CJ’s judgment in the Yokohama Rubber Co. Ltd and EUIPO v Pirelli Tyre SpA (CJ;C-818/18 P & C-6/19 P) regarding the validity of a figurative trade mark protecting the shape of a single groove in a tyre tread. We also report the High Court’s decision on trade mark infringement and passing off in Claire Stone v Alexandra Wenman (Judge Melissa Clarke; [2021] EWHC 2546 (IPEC); 22 September 2021) and summarise the decision in Joaquim José Esteves Lopes Granja v EUIPO; Instituto dos Vinhos do Douro e do Porto, IP (IVDP) (T-417/20).
