On 28 June 2025, the Act on Ensuring that Economic Operators Meet the Accessibility Requirements of certain Products and Services (the “Act”) enters into force. The Act implements the European Accessibility Act (EU Directive 2019/882) (the “EAA”) in Poland.

What is the EAA and when does it apply?

The legislation aims to make products and services more accessible for consumers with special needs. It imposes various obligations on manufacturers, authorised representatives, importers, distributors, and service providers. The products and services the Act covers include computers, smartphones, e-books, payment terminals, ticket vending machines, retail banking services, telecommunications, and e-commerce. Businesses should conduct regulatory a GAP analysis and, where applicable, implement the new requirements under the EAA.

Why act now?

Most obligations (including e-commerce services) take effect on 28 June 2025. Non-compliance could result in financial penalties of up to 10% of annual turnover (among other sanctions). The Polish supervisory authorities have already issued initial guidelines that suggest they will be actively scrutinising the market for compliance.
