Bird & Bird's Warsaw Energy & Utilities team has supported Qair Polska S.A. in negotiating one of the largest, in terms of volume, Corporate PPAs with physical delivery of electricity on the Polish market.
Legal support included negotiating the Term Sheet, as well as the wording of the Corporate PPAs and the contracts with the trading company. Bird & Bird also advised on contractual issues along with energy regulation and renewable energy matters.
Under the contractual framework, Qair Polska S.A. will supply one of Poland's largest off-takers with a total of 2 TWh of electricity from wind and solar farms over a 12-year period. The contracts were concluded on a pay-as-produced basis and provide for the physical delivery of 100% of the electricity generated at these installations, along with guarantees of origin, to the final off-taker.
The project was advised by a team of lawyers led by Grzegorz Pizoń (Partner heading the Energy & Utilities team), who was supported by the following team members: Wojciech Korga (Senior Associate), Sara Radzicka-Tolwaj (Senior Associate) and Tomasz Chabrzyk (Associate).
