I'm Counsel in our international Public Procurement group in Denmark where I use my deep-level experience of procurement of complex IT contracts to advise clients from the beginning of the procurement processes with preparation of the tender material to the subsequent contract management. Since July 2021, I have been a certified IT lawyer which underlines my extensive focus on IT.
Over the years, I have specialised in mainly assisting national agencies, municipalities, regional bodies, utilities and public companies in organising and implementing EU procurement, national procurement and other projects covered by public procurement law. In addition to this, I have assisted several tenderers in preparation of their tenders which gives me an extensive understanding of both sides of a procurement process. This ensures an overview and a well-balanced contract for both the contracting authority and the tenderer.
In the preparation of the procurement processes, I help our clients with drafting a procurement strategy, completion of market dialogue, drawing up the tender documents, including drafting the contract and relevant annexes. Furthermore, I deliver constructive feedback and quality assurance of the requirement specification. When the procurement process is officially started, I assist our clients with completion of the procurement from A to Z.
Since the the Danish Public Procurement Act came into force in 2016, I have completed numerous negotiated procedures which have demonstrated great value. The negotiated procedure is often applicable to IT procurement and this procurement process has generated great value in which dialogue during negotiations resulted in mutual understanding among both parties. I have been the chairman of most of the negotiated procedures, which has helped the contracting authority to focus on the dialogue rather than the formal framework. I also assist our clients to assess the need and possibilities of changing the tender material after a conducted negotiation. Finally I assist the clients with securing the conditionality of the tenders and assisting the client to accomplish a correct evaluation of the submitted tenders and ensure correct completion and documentation of the process.
Besides being a traditional adviser, I am certified as a professional SCRUM master. I often assist clients during complex projects as project manager and I have been on several secondments on major projects where I advised the client as a project manager.
I have extensive experience with access in accordance with the Public Administration Act, as well as the preparation of procedural documents - both for complainants and defendants - in appeal cases brought before the Danish Complaints Board for Public Procurement.
I am regularly invited to teach on IT acquisitions, framework agreements, the Utilities Directive and Total Cost of Ownership and the calculation in this regard. In addition to my skills as adviser and teacher, I write articles for our procurement newsletter.
