Fulvio Mellucci

I am Senior Counsel in our Intellectual Property Group in Milan where I offer our clients over 35 years' experience as a leading authority on Industrial Intellectual Property Law.

In the course of my activity I have learned to understand the needs of clients, which have gradually changed over the years. Today, my goal is to assist them in the most proactive way possible, providing them with timely and concrete answers and, where appropriate, with strategical hints in relation to the protection and development of their IP assets.

Focusing on issues including patents and know-how, trade marks, copyright and design and unfair competition, I assist and advise our major clients active in various industrial sectors (life sciences, chemicals, electronics and telecommunication, fashion, automotive, food and consumer) in national and multi-jurisdictional litigations, as well as in drafting and negotiating agreements concerning IP rights.

I also regularly lecture in specialist courses in IP organised by the Faculty of Pharmacy of the University of Milan and for private organisations. I am a member of EPLAW, LIDC, AIPPI and LES.

I am a native Italian speaker and I am fluent in English.

• Advising various pharma companies on the interpretation of Art. 3 of Regulation (EC) No 469/2009 concerning the supplementary protection certificate for medicinal products.
• Drafting Freedom to Operate opinions in pharma-biotech matters.
• Clearance activity in favour of various clients interested in filing applications for newly created trade marks.
• Opinion in favour of a multinational group of companies concerning the management of their worldwide trade marks portfolio.
• Drafting of numerous opinions on the best procedural strategies to be adopted for the protection of industrial and intellectual property rights.

• Assisting a food company in obtaining PI orders against infringers of its well-known trade mark before various Italian Courts.
• Assisting a multinational pharma company in multi-jurisdictional proceedings brought against it by a competitor for patent infringement, obtaining the rejection of the claim.
• Assisting an important pharmaceutical company in a proceeding directed to enforce a patent concerning a second medical use.
• Assisting a multinational company, active in the field of telecommunications, in a multi-jurisdictional proceeding, then settled, aimed at obtaining the revocation of a bundle of standard essential patents owned by a competitor.
• Assisting an information society service provider in a proceeding for copyright infringement and concerning the interpretation of the exemptions from liability established in the Directive 2000/31/EC on electronic commerce (Arts. 12 – 15).
