Khaled Farah

I am an associate in our International Dispute Resolution group in the UAE, specialising in advising clients on complex commercial disputes in both the public and private sectors, along with associated risk management and jurisdictional issues.

A large part of my practice is high-value arbitration – both ad-hoc and institutional, on a range of insurance, complex projects and sporting disputes – but I also have broad experience in advising clients in the energy, financial services, technology and automotive sectors on both English law litigation and alternative dispute resolution (including mediation).

Many of the matters across our IDR group have an international element, and by adopting an integrated approach across our offices in Europe, the Middle East and Asia-Pacific, I've helped deliver commercial resolutions for a number of international organisations.

As part of Bird & Bird's Product Liability team, I also specialise in helping global organisations manage legal and regulatory risks associated with product safety or hazard issues in the marketplace. This includes handling product liability issues, recalls, contractual protections, insurance, and interactions with enforcement regulators.

• Successfully securing declaratory relief in respect of an invalidly terminated licence and distribution agreement for a pharmaceutical company (licensee) in an LCIA arbitration against an international pharmaceutical group (licensor).
• Successfully defending an international insurance group in a London-seated reinsurance arbitration concerning a dispute over the scope of reinsurance coverage in connection with litigation costs paid by the cedant over a failed construction project in the US.
• Acted for a global provider of technology services in a public procurement claim against the UK Home Office concerning the award of five contracts for the provision of visa and citizenship application services.
• Acting for Moroccan natural gas traders in a claim in restitution concerning the attempted revocation of SWIFT payment instructions to a Swiss Bank, applying principles of Swiss Law.
• Advising the world's second largest e-commerce platform with respect to the products and digital services sold by its associated entities and third-party sellers on its international marketplace.
• Advising sports governing bodies in relation to eligibility criteria and/or disciplinary proceedings.
• Acting for an international foreign exchange provider in a litigation and mediation concerning the restitution of sums allegedly not exchanged into foreign currency.
