New consumer protection rules arrive in Italy: the decree implementing the Omnibus Directive has been published

On 18 March 2023, Legislative Decree No. 26 (the "Legislative Decree") implementing Directive (EU) 2019/2161 of the European Parliament and of the Council of 27 November 2019 amending Council Directive 93/13/EEC and Directives 98/6/EC, 2005/29/EC and 2011/83/EU of the European Parliament and of the Council for better enforcement and modernisation of Union rules on consumer protection (the "Omnibus Directive"), was published in the Official Journal.

The Legislative Decree - which will definitively enter into force on 2 April 2023 - considerably expands the protection granted to consumers by introducing significant amendments and additions to Legislative Decree No. 206 of 6 September 2005 (the "Consumer Code").
